Daily Quest by October Academy
Article 1 (Purpose)
These Terms and Conditions aim to define the terms, procedures, and other necessary matters regarding the use of the services provided by October Academy Co., Ltd. (hereinafter referred to as the 'Company'), including the October Academy service and related ancillary services (hereinafter referred to as the 'Service').
Article 2 (Definitions)
The terms used in these Terms and Conditions are defined as follows:
1. Website: The official website operated by the Company to provide the Service: Daily Quest
2. Member: An individual who has entered into a service use agreement with the Company in accordance with these Terms and Conditions and uses the services provided by the Company.
3. Non-member: An individual who uses the information and services provided by the Company without registering as a member.
4. ID: A combination of letters and numbers selected by the member and approved by the Company for member identification and service use.
5. Password: A combination of letters and numbers set by the member to protect their communication confidentiality.
6. Content: Symbols, letters, voices, sounds, images, videos, shapes, colors, images, etc. (including combinations thereof) provided by the Company to members, including results created by members through service functions.
7. Paid Service: Paid features provided within the Service.
Article 3 (Publication, Effectiveness, and Amendment of Terms and Conditions)
- The Company shall post the contents of these Terms and Conditions on the initial screen of the Service so that members can easily recognize them. However, the contents may also be made available through linked screens.
- The Company may amend these Terms and Conditions to the extent that it does not violate relevant laws such as the Act on the Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Transactions, the Electronic Financial Transactions Act, the Electronic Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Door-to-Door Sales Act, and the Framework Act on Consumers.
- If the Company amends these Terms and Conditions, it shall specify the application date and the reason for the amendment and notify them along with the current Terms and Conditions on the initial screen of the Company from 7 days before the application date. However, if the amendment is unfavorable to the member, the Company shall notify it at least 30 days in advance.
- If the member does not explicitly express their intention to terminate the contract until the application date notified under paragraph 3, it shall be deemed that the member has agreed to the amended Terms and Conditions.
- Matters not specified in these Terms and Conditions and the interpretation of these Terms and Conditions shall be governed by the Act on the Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, other relevant laws, or commercial practices.
- The Company may post an ethics guide within the Service, including content that respects crime prevention and social ethics related to service use, and such ethics guide shall be considered part of these Terms and Conditions. By agreeing to these Terms and Conditions, the member is also deemed to have agreed to comply with the ethics guide.
Article 4 (Membership Registration and Management)
- The service use agreement is concluded when the applicant agrees to these Terms and Conditions in the membership registration guide, fills out the application form provided by the Company, and applies for the use of the Service, and the Company approves it.
- The applicant must use real information, and each member can only apply for one use.
- Members who do not enter their real name or actual information cannot receive legal protection and may be restricted from using the Service.
- If there is a change in the information entered at the time of membership registration, the member must modify it online or notify the Company of the change through email or other methods.
- The Company is not responsible for any disadvantages arising from the member's failure to notify the Company of changes under paragraph 4.
- Persons under the age of 14 can create an account only with the consent of a parent or legal guardian.
Article 5 (Approval of Application for Use)
- The Company may withhold approval of the application for use until the reason for the restriction is resolved in the following cases:
- If there is no room in the service-related facilities
- If there is a technical or business disruption
- If the Company deems it necessary due to other circumstances
- The Company may not approve the application for use in the following cases:
- If the application was made using someone else's name
- If the application was made with false member information
- If the application was made for the purpose of disturbing social order or morals
- If the application was made to lend or resell the service use rights
- If the applicant was disqualified from membership due to violation of the Terms and Conditions and is reapplying within one year
- If the application does not meet other requirements set by the Company
Article 6 (Obligations of the Company)
- The Company shall make every effort to provide the Service stably and continuously in accordance with these Terms and Conditions.
- The Company shall establish an appropriate security system to protect personal information so that members can use the Service safely, and shall strictly comply with the privacy policy.
- If the Company recognizes that the opinions or complaints raised by members are justified, it shall handle them immediately. However, if immediate handling is difficult, the Company shall notify the member of the reason and the processing schedule.
Article 7 (Obligations of Members)
- Members shall familiarize themselves with and comply with these Terms and Conditions, notices from the Company, and service use guides, and shall not engage in the following acts:
- Providing false information when applying for or changing the Service
- Stealing another person's information or payment method
- Altering information posted by the Company or interfering with the Service
- Collecting, storing, posting, or distributing other members' personal information or account information without authorization
- Replicating, disassembling, or modifying the Service through reverse engineering, decompiling, disassembling, etc.
- Using hacking, automatic connection programs, etc., to burden the Company's servers or interfere with normal services
- Lending, transferring, or granting access rights to the account to a third party
- Transmitting or posting information prohibited by the Company (e.g., computer programs)
- Engaging in gambling or inducing such behavior, posting obscene or vulgar information, or transmitting or distributing words that cause shame, disgust, or fear
- Unauthorized reproduction, distribution, or commercial use of information obtained through the Company's services, or exploiting bugs
- Infringing on the intellectual property rights of the Company or third parties
- Damaging the reputation or interfering with the business of the Company or third parties
- Engaging in other illegal or unjust acts
- Members shall comply with relevant laws, these Terms and Conditions, service use guides, notices related to the Service, and matters notified by the Company, and shall not interfere with the Company's business.
- Members are responsible for managing their ID, password, and payment method information, and the Company is not responsible for any problems arising from the member's negligence in management.
Article 8 (Use of the Service)
- Members shall use the Service in compliance with the provisions specified in these Terms and Conditions.
- Members can use the Service from the time the Company approves their application for use. However, some services may require a specified date or certain conditions to be met.
- The Service is available 24 hours a day, 365 days a year, in principle. However, the Service may be temporarily suspended due to business or technical reasons. In such cases, the Company shall notify in advance, and if prior notice is not possible due to unavoidable reasons, the Company shall notify afterward.
- The Company may set or change the types and number of devices that can use the Service per member.
- Members must comply with the following Fair Use Policy (FUP) when using the Service:
- FUP is a policy that requires reasonable and responsible use of services that allow unlimited use.
- Members must choose an appropriate plan that matches their occupation and business size, and the Company prohibits malicious use such as abnormal API expansion, bot creation, and account sharing.
- If suspicious activities such as abnormal usage and sharing of account login details with other users are detected, the account may be blocked or permanently deleted without prior notice, and no refunds will be made in this regard.
