Turtle is a browser extension software ("Service") offered by Turtle ("Company", "we"), according to the terms of service (the "Terms of Service"), as well as the privacy policy (the "Privacy Policy"), which together are a legally binding agreement for the use of the Service, so please review them periodically.


2. Changes to the Terms of Use

We are constantly making improvements to the website http://turtle.apps-featured.net/ ("Website") and to the Service that we provide, therefore we reserve the right to make necessary changes to these Terms of Service at any time, without prior notice to the individuals accessing the Website or using the Services (that will be further referred to as "you" or "the Users").

- The Website or Service includes links and banners linking to other websites that are neither owned nor controlled by the Company. The Company is not responsible or liable for any content, advertising, products, or other materials on, or available, from such sites or resources. As control over such sites and resources cannot be performed, by using the Service you acknowledge and agree that we are not responsible for the availability of such external sites or resources, that we do not endorse and that we are not responsible or liable for any content, advertising, products, product information or any other materials that are made available on or through these websites. Furthermore, you acknowledge and agree that any damage or loss caused, or allegedly caused, by the use of such external resources will not be accounted to the Company or any of its third parties;
- Any matter in relation to or arising from the use of the Service, including any breach or suspected breach of these Terms of Service, or your violation of any law or of the rights of any third party that can lead to a third party soliciting claims and/or damages to us and our partners and employees, will be compensated by you;
- Any liability for damage to your computer system or loss of data that results from using the Service shall not be accepted by the Company. We also cannot guarantee the integrity of the files that you may download or that they are free of viruses, contamination or other types of threats;
- By accessing the Website (browsing, registering) or using the Service, you accept and agree to be bound by these Terms of Service, to not use the Website or Service for any other purposes than the ones allowed by its owners and to not formulate or take action regarding any claims from the Company and its staff.


4. Description of the Service

The Service includes but is not limited to a browser add-on software that provides, among others, search functionalities based on keywords or product categories, merchant and product reviews, discount coupons and any other functionality that shall be added in the future.

The main purpose of the Service is to provide users with information regarding the products and services offered by third parties (the "Merchants") and also to provide web links to the online shops selling those products and services. The Company is not acting as agent for the Merchants whose products are being listed within the Service and is neither selling, reselling nor licensing the products listed.

The Company is not a party in any transaction or contract that you may establish with any Merchant that has products listed within the Service and has no liability with regard to the products listed.

The Company does not at any time warrant that the Service Content is free from errors or accurate.

The comments and reviews published within the Service belong to third parties and they do not guarantee the quality and performance of the products, services or merchants. The entries published by users do not express the Company’s endorsement of any opinion or advice expressed.
The registered merchants or third parties can pay for a preferential positioning within the search results, but this will not influence the reviews, comments or approval posted by users and displayed within the Service.

The Content of the Service will be used for information purposes only; any commercial use of the Content requires prior written permission from the Company.


5. Responsibility towards the products and offers displayed

The Company:

- Will not warrant for the content listed within the Service, provided by its partners or by the users;
- Cannot be held responsible for the price changes of the listed products or any damages and profit loss caused by those changes;
- Cannot be held responsible for the content, quality or nature of the listed websites and products;
- Cannot be held responsible for the damages incurred by accessing the links listed within the Service. The Company will not warrant for the accuracy of the product descriptions listed within the Service;
- Will not warrant and cannot be held responsible for the products that you have purchased. You agree to not involve the Company in any way in disputes that may occur between you and any Merchant listed.


6. Legal obligations and limits on Liability

Hyperlinks, advertisement banners, product information and corporate information and the like do not constitute a recommendation from the Company of third parties. The Company assumes no liability for their contents, inclusive of prices and the availability of products.

The add-on and received information within the Service, including any relation to third parties or their products and services, are provided on the basis of "AS IS" and "AS AVAILABLE". To the extent permissible by law, the Company excludes all warranties (whether expressed or implied by law), including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy of the add-on or the retrieved information.

The Company is not liable for any of the following losses or damage, whether such damage or losses were foreseeable or known or otherwise: loss of data, loss of revenue or anticipated profits, loss of business processes, loss of opportunity, loss of goodwill or reputation, losses suffered by third parties, or indirect all, consequential, special or exemplary damages, resulting from the use of the Service regardless of the form of action.

Apart from the rights, granted by this license, no more rights to the add-on will be granted.

The names, images and logos identifying the Company, the Website or the Service or third parties and their products and services are protected by copyright and trademark of the Company and / or third parties. Nothing in these Terms of Service will be interpreted as conferring any license or rights to use any trademark, registered designs or copyrights of the Company or any other third party.
